The short version
This Next House is a personal home-buying organization tool. Use it to save and track homes as you search — not to scrape data or run commercial operations. We don't sell your data. The Service is for US residents 18 and older. If something goes wrong, our liability is limited. Questions? Email [email protected].
1. Acceptance of Terms
By creating an account or using the This Next House service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Not That CRM LLC ("we," "us," or "our"), the company that operates This Next House.
2. Description of Service
This Next House is a home search companion that helps buyers organize, track, and evaluate residential real estate listings. The Service includes a web application and a browser extension that together allow you to save, annotate, rate, and compare homes during your buying process.
3. Eligibility
Age: You must be at least 18 years of age to use the Service.
Residency: The Service is intended solely for residents of the United States. By creating an account, you confirm that you are a US resident. Use of the Service outside the United States is not authorized.
Legal capacity: You represent that you have the legal capacity to enter into a binding contract.
4. Account Registration and Security
Account creation: You must provide accurate, complete, and current information when registering. You are responsible for maintaining the confidentiality of your credentials.
Account security: You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
One account per person: Each individual may only maintain one active account. Co-buyer access is provided through the household invite feature, not a separate account.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Scrape, crawl, or use automated means to extract data from the Service.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Upload or transmit any malicious code, viruses, or disruptive content.
- Use the Service for commercial real estate investment, data aggregation, or resale of listing data.
- Impersonate any person or entity or misrepresent your affiliation.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Not That CRM LLC. The This Next House name, logo, and related marks are trademarks of Not That CRM LLC. You may not use our trademarks without prior written permission.
7. User Content
Your content: You retain ownership of notes, photos, and other content you upload to the Service ("User Content").
License to us: By uploading User Content, you grant Not That CRM LLC a non-exclusive, worldwide, royalty-free license to store, display, and process that content solely to provide the Service to you.
Responsibility: You are solely responsible for your User Content and represent that you have all rights necessary to grant the above license.
8. Third-Party Services and Data
The Service integrates with third-party services (such as Google Maps and Google AI) to provide commute data and property listing extraction. We are not responsible for the accuracy or availability of data provided by these third parties. Your use of third-party services is subject to their respective terms and privacy policies. 9. Disclaimers
No real estate advice: The Service is an organizational tool. Nothing in the Service constitutes real estate, legal, financial, or investment advice. Always consult a licensed real estate professional before making purchasing decisions.
Data accuracy: Listing data captured via the browser extension is read from third-party listing sites and may be incomplete, outdated, or inaccurate. We make no warranty as to the accuracy of captured listing data.
"As is": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NOT THAT CRM LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Termination
By you: You may close your account at any time by contacting us at [email protected]. Upon closure, your data will be deleted in accordance with our Privacy Policy.
By us: We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law.
Effect of termination: Sections 6, 9, 10, and 12 of these Terms survive termination.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration in Milwaukee, Wisconsin, except that either party may seek injunctive relief in court for intellectual property violations.
13. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice in the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. The "Last Updated" date below reflects the most recent revision.
